{"id":28459,"date":"2020-11-06T10:28:26","date_gmt":"2020-11-06T02:28:26","guid":{"rendered":"http:\/\/www.ikim.gov.my\/new-wp\/?p=28459"},"modified":"2020-11-06T10:28:26","modified_gmt":"2020-11-06T02:28:26","slug":"do-not-let-property-continue-to-freeze","status":"publish","type":"post","link":"https:\/\/www.ikim.gov.my\/en\/do-not-let-property-continue-to-freeze\/","title":{"rendered":"Do Not Let Property Continue To Freeze"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Frozen Property is the\nproperty which is still detained from any transaction or in the matter of\ndistribution of the property to the heirs after the death of the property owner\nuntil the perfect administrative process is carried out. Frozen Property is an issue\nthat our country is facing, and the situation is deteriorating. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2004, the value of\nFrozen Property in our country was estimated at 15 billion ringgit.\nUnfortunately, the number of frozen properties is increasing every year until\nJanuary 2020, and the media states that the number has reached 70 billion\nringgit! This situation concludes that over the past 16 years, the total value\nof Frozen Property on average has increased by 3.44 billion ringgit per year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the figures stated\nby the media may not be accurate, the issue of Frozen Property is a problem\nthat should not be taken easily. What is more, in terms of sharia, matters\ninvolving property will be questioned in the hereafter. Regardless of a\nperson\u2019s position, whether as property owner or as beneficiary, or perhaps as a\ntrustee of property left by a property owner after his or her death, everyone\nwill be asked about the responsibilities that they have while living in the\nworld.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, in discussing\nthe issue of Frozen Property, almost all professional in this industry, has the\nsame voice when raising the causes that lead to an increase in Frozen Property\nin the country, especially in managing property for deceased owners. Among them\nare: the heirs do not have knowledge related to the process in making a claim;\nhigh cost of management; the heirs have no consensus; heirs have no allocation\nof time; and procrastinate in managing the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Inadequate\nknowledge in managing property can be seen as the most significant cause of\nthis problem. With the relevant knowledge, a person can be considered to be\nhalfway in managing the property. That basic knowledge of course includes\nknowing the law and sharia principles in property management even at a minimal\nlevel. From this point on, one will find a way to manage the property because\nthis knowledge can basically create awareness in carrying out the\nresponsibilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Starting with this knowledge, usually one will have the awareness and\nunderstanding that acting earlier is a wise action as this will prevent any\nissues from arising when he dies. This means that a wise property owner will\nnot leave his property alone, even the property is managed properly while he is\nstill alive, healthy and sane. Such wisdom can also of course avoid the causes\nthat result in property being managed slowly and late.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wise property management also means that the property owned can be\ndistributed to those who are eligible whether to family members or not, and\nproperty rights can be fulfilled perfectly. Indirectly it can also prevent the\nproperty from freezing and cannot be utilized.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The impact of property management in a broader context or scope will\nguarantee things like this, namely, ensuring property circulates and moves\nvigorously in various sectors of life so as to enable the expansion of property\nand its widespread and comprehensive use; as well as stimulates economy\nactivity and it can expand the circulation of property so that it can be\nenjoyed by the community fairly.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Managing family property effectively is like preparing a shelter. Rain is\ninevitable destiny, but with a shelter, it can protect anybody from rain, which\nmeans that the welfare of those left behind will continue to be protected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moreover, if a property\nowner has the following situation: does not have a son whose position will\n(according to sharia law) spend the rest of the inheritance; has no children;\nonly has adopted children; has a special child or bedridden child; and has\nchildren under the age of 18, some of which require a trustee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, every\nindividual property owner will not know the time of his death; situations that\nmay reduce his ability as a healthy and normal person; as well as any incidents\nor changes that could cause mental disability. In this case, the Prophet SAW\nadvised to: <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTake benefit of five\nbefore five: your youth before your old age: your health before your sickness;\nyour wealth before your poverty; your free time before you are busy, and your\nlife before your death\u201d (Narrated by Ibn Abbas RA and reported by al-Hakim).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the relevant\nknowledge is the main key to this problem, but based on the author\u2019s\nobservation, the necessary knowledge of the Muslim community in Malaysia is\nstill not encouraging enough. Some have even heard of the terms hibah (gift),\nwasiat (will) and even faraid (Islamic law of inheritance), but the available\nknowledge is not enough in terms of how these property management instruments\nwork. This situation needs to be taken into account by all parties so that the\nknowledge of our society can be enhanced. Our\nhope is that as society&#8217;s understanding increases over time, problems related\nto frozen property can be reduced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As an\ninstitution that is concerned about this problem, IKIM has been and is actively\nworking to spread understanding and guidance to the public to improve understanding\nand skills in property management.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Frozen Property is the property which is still detained from any transaction or in the matter of distribution of the property to the heirs after the death of the property owner until the perfect administrative process is carried out.
